Things to know about KKDİK;

KKDİK is the abbreviation of the Regulation on Registration, Evaluation, Permission and Restriction of Chemicals and was created by harmonizing the Reach legislation used in European countries to protect human health and the environment with Turkish legislation. The KKDİK Regulation, published by the Ministry of Environment, Urbanization and Climate of the Republic of Turkey on June 23, 2017, aims to protect human health and the environment from the negative effects of chemicals at the highest level.

The main objectives of KKDİK;

To protect human health and the environment from the harms of chemicals at a high level.
To oblige those who place chemicals on the market (producers, manufacturers, importers) to ensure the safe use of chemicals.
To increase competition and innovation in the Turkish chemical industry
To reduce animal experiments used in the evaluation of the harmful properties of substances and to encourage alternative methods.
Companies that are chemical manufacturers and importers are given a period until 31.12.2023 to pre-register and register. Companies that fail to complete their registrations within the specified time will be prohibited from placing chemical products on the market and importing chemicals.

KKDİK REGULATION

As stated in Article 65, KKDİK Regulation was prepared in relation to the EU-Turkey Customs Union relations legislation that came into force in 1995 as part of Turkey’s harmonization process with the European Union. Following the REACH regulation that came into force in the European Union in 2008, a draft KKDİK regulation was published by the Ministry of Environment and Urbanization in 2013 for the purpose of harmonization in the legislation. Since KKDİK is similar to REACH implemented in European countries, it is also called Turkish Reach. KKDİK regulation imposes an extra burden on companies that import chemicals to the Turkish market, whether they are resident in Turkey or international importers, distributors or manufacturers. According to KKDİK, manufacturers that supply chemicals to the national market from outside Turkey must appoint a Representative resident in Turkey.

With the KKDİK regulation, a “Registration” obligation has been introduced for 1 ton and above chemical substances produced in Turkey and 1 ton and above substances imported to Turkey on their own or in mixtures. In addition, article manufacturers and importers have “Registration” and “Notification” obligations for the articles defined in the KKDİK regulation.

According to the KKDİK regulation, substances manufactured or imported on their own in an amount exceeding one (1) ton per year and chemical substances found in a mixture or article.

According to the KKDİK regulation, the parties that will fulfill the registration obligation are called manufacturers and importers. Pre-registration procedures started on 23.10.2017 according to the KKDİK regulation and ended as of 31.12.2021. However, since the registration process will continue until 31.12.2023 and taking into account the product to be placed on the market, manufacturers and importers who have not pre-registered will be able to register until 31.12.2023. Manufacturers and importers who have not registered by 31.12.2023 must register. Manufacturers and exporters who have not registered by this date will not be able to place products on the market afterwards.
